Your use of this website is subject to the following Terms and Conditions and other notices posted on this website. It is the responsibility of customers to read and understand these Terms and Conditions and any other notices on this website. Company Information The NewsPools website is owned and operated by Gnutrade NV. GnuTrade abides by the laws and regulations of Curacao and the Central Government of the Netherlands Antilles. GnuTrade will maintain its business license and operate under the authority and within the extent of that business license at all times. General A customer is deemed to have accepted these Terms and any other notices posted on the NewsPools website, by opening an account or using the NewsPools service. GnuTrade reserves the right without explanation to refuse registration or to refuse, restrict, cancel or limit any bet or part of any bet from any customer. Only one GnuTrade account may be opened and used per customer, street address, computer and IP address. The name on your GnuTrade account must match your true and legal name and identity. GnuTrade reserves the right to enforce limits on withdrawals and deposits on customer accounts at its sole discretion. All bets made using the NewsPools service are subject to specific rules as posted on the NewsPools website. These rules are subject to changes and revisions without prior written notice. GnuTrade will strive to respond to customer enquiries as soon as possible, usually the same business day and within a maximum of two business days. Customer Responsibility It is the personal responsibility of customers and visitors to this site to ensure that they understand and comply with their local laws and regulations pertaining to betting over the internet, as these laws and regulations vary from country to country. It is not the intention of this website that it be used by a customer in any jurisdiction where it would be contrary to local law or regulation. It is a customer’s responsibility to ensure the confidentiality of their account and Login details. In the event where a customer believes that this has been compromised, a customer must notify GnuTrade immediately. Any bet made where the Login details are correct and there are sufficient funds will be deemed as valid unless notified otherwise. The customer is responsible for controlling access to the account. The customer is responsible for ensuring no minors gain access to the account. All customers must be aged 18 or over. If a customer does not comply with the Terms and notices specified on the NewsPools website, the customer’s account may be suspended or closed. Third Party Services GnuTrade accepts no responsibility for any goods or services referred to on this website not under its control. GnuTrade makes no warranties or representations for these services. The customer indemnifies GnuTrade for any loss or damage arising from the use of these goods or services from any third party. Disclaimer and Limitation of Liability GnuTrade will not have any liability for any loss or damage without limitation that are alleged to have resulted from the NewsPools website or its’ content, including but not limited to, delays or interruptions in service or communication, a customer’s or any other person’s misuse of the site and its content, and any errors or omissions in content. This applies to any transaction between a customer and GnuTrade and in the event that an unauthorised person accesses the customer’s account. Money Laundering and Fraud GnuTrade has a responsibility to comply with international money laundering laws and to report any suspicious activities as defined by those laws to the appropriate authorities and to suspend any account suspected of breaching those laws. The Company in its sole discretion may refuse to do business (including withdrawals and reversing transactions) with a customer who is suspected of money laundering or a customer who does not accept and comply with any policies and procedures imposed by GnuTrade. These procedures include but are not limited to the following: The customer is required to fill in a form and provide all documents requested by GnuTrade to confirm their identity. GnuTrade may require the customer to provide documentation to confirm their identity at any time and at GnuTrade’s sole discretion. The use of proxy servers, except for those assigned by ISPs for normal use is strictly forbidden. This rule also applies to, but is not limited to, anonymous website proxies and any other means to hide your identity. GnuTrade, in its sole discretion, may close any accounts or void any bets made by any person or persons which GnuTrade considers is attempting to defraud the company. Each customer is fully responsible for paying all monies owed to GnuTrade. In respect of any payment made by any customer, that customer agrees that he or she will not make any charge-backs, and/or deny or reverse any such payment and will reimburse GnuTrade for any charge-backs, denial or reversal of payments made and any loss suffered by GnuTrade as a consequence. GnuTrade may, at its sole discretion, cease to provide service or payment to certain users or to users paying with certain credit cards. Termination GnuTrade has the right to terminate the customer’s account if it determines, in its sole discretion that the customer has breached its Terms and Conditions or any other notices posted on the NewsPools website or for any other reason. A customer may close his or her account at any time by contacting support by email. Notwithstanding evidence or suspicion of money laundering and/or fraud, real money cash balances remaining on the account will be refunded to the customer by cheque upon completion of the withdrawal request form in the Cashier link on the website. Jurisdiction These Terms and Conditions and the relationship between GnuTrade and its Customers are governed by the laws of Curacao. The parties submit to the sole jurisdiction of Curacao in determining any disputes that may arise in relation to these Terms and Conditions. Severability If the whole or any part of these Terms and Conditions is invalid, unenforceable or illegal in a jurisdiction, then that term or condition or part of that term or condition will be severed in respect of that jurisdiction. The remainder of the Terms and Conditions will remain valid and enforceable. Amendment GnuTrade reserves the right to amend the information on this website at any time and without prior notice. The Terms and Conditions may be amended at any time and GnuTrade will provide notice of such amendments by posting the changes on the website. Assignment The customer may not assign any of his or hers rights and/or obligations under this Agreement without GnuTrade’s prior written consent. Suspension of Service GnuTrade may suspend the NewsPools service as a result of circumstances within or outside its control. GnuTrade will not have any liability for any loss or damage without limitation that are alleged to have resulted from this suspension of service. Force Majeure GnuTrade will not be liable if it is prevented from performing its obligations under these Terms and Conditions in the event of force majeure. This suspension shall continue for as long as the force majeure continues. Notices We will send notices to the email address provided by the customer on entering into this Agreement. Any notice sent will be deemed to be delivered at the time of sending it. It is every customer’s responsibility to inform GnuTrade if there is any change to this address. |
